Whistleblower Protection at the IQB: Internal Reporting Channel for the IQB at HU  🔗

Under EU Directive 2019/1937, public and private organisations must set up an internal reporting channel to protect employees from retaliation when they report legal breaches. The Whistleblower Protection Act (HinSchG) is designed to protect reporting persons (“whistleblowers”) from retaliation and to ensure that potential cases of suspected misconduct can be reported. Confidential reports may be submitted regarding legal violations and other circumstances relevant to criminal law. The internal reporting channel aims to prevent and identify unlawful conduct, including financial crime, corruption, or risks to health and safety.

Potential violations that may result in criminal penalties or fines and that relate to the Institute for Educational Quality Improvement (IQB) or its staff can be reported to the IQB’s internal reporting channel at Humboldt-Universität zu Berlin (HU).

For written reports (email or post), please include “IQB” in the subject line. For verbal reports, state clearly at the start of the conversation that the report relates to the IQB.

Confidentiality 🔗

The identities of whistleblowers and third parties mentioned in the report are generally treated as confidential. The whistleblower must not suffer any disadvantage as a result of making a report (§ 9 HinSchG).

However, if the whistleblower intentionally or with gross negligence reports incorrect information about violations, they are not protected under the HinSchG. In the event of an intentionally or grossly negligently false report, the whistleblower is liable for any resulting damage (§ 38 HinSchG).
